Acceptance of Terms

By accessing or using the Funded Ocean website at fundedocean.com ("Website") and any associated services ("Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not access or use our Services.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Funded Ocean ("we," "us," or "our"). We reserve the right to update or modify these Terms at any time, and your continued use of the Services following any changes constitutes acceptance of those changes.

About Funded Ocean

Funded Ocean is a proprietary trading evaluation firm that offers simulated trading challenges. Our platform allows traders to demonstrate their skills on simulated accounts. Traders who successfully pass our evaluation challenges may become eligible for profit-sharing arrangements on funded simulated accounts.

It is important to understand that all trading conducted through Funded Ocean is on simulated accounts with virtual funds. No real capital is at risk during the evaluation process, and funded accounts operate under simulated market conditions.

Eligibility

To use our Services, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction
  • Have the legal capacity to enter into binding agreements
  • Not be a resident of any jurisdiction where our Services are prohibited or restricted
  • Provide accurate and truthful information during registration and identity verification
  • Not have been previously banned or terminated from our platform

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if we determine that eligibility requirements are not met.

Account Registration

To access our Services, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • You may only create and maintain one account per person
  • Account sharing, selling, or transferring is strictly prohibited
  • You must notify us immediately of any unauthorized use of your account
  • We may require identity verification (KYC) before processing payouts or at any point during your use of our Services

Challenge Rules and Simulated Trading

Funded Ocean offers simulated trading challenges with specific rules, targets, and parameters. By purchasing and participating in a challenge, you agree to abide by the following:

  • All challenges are conducted on simulated accounts with virtual funds — no real money is traded at any stage
  • You must adhere to the specific challenge rules including profit targets, maximum drawdown limits, daily loss limits, and minimum trading day requirements
  • Violating any challenge rule may result in immediate disqualification and forfeiture of the challenge fee
  • Challenge parameters, including account sizes, leverage, and instrument availability, are set at our sole discretion and may be updated at any time
  • We reserve the right to review all trading activity and disqualify participants who engage in prohibited trading strategies or manipulative behavior

Detailed challenge rules for each plan are available on our website and form part of these Terms. It is your responsibility to review and understand the specific rules of any challenge before purchasing.

Fees and Payments

Challenge fees are clearly displayed on our website and must be paid in full before you can begin a challenge. All fees are charged in the currency specified at checkout.

  • Prices are subject to change without prior notice; the price at the time of purchase applies
  • Payments are processed through secure third-party payment processors; we do not store your full payment card details
  • You are responsible for any additional fees charged by your payment provider, bank, or financial institution
  • All transactions are final unless eligible for a refund under our Refund Policy

Profit Splits and Payouts

Traders who successfully complete the evaluation process and meet all requirements may become eligible for profit-split payouts on their funded simulated accounts:

  • Profit-split ratios are specified for each plan and may vary by account type and tier
  • Payouts are subject to identity verification (KYC) and compliance with all challenge rules and these Terms
  • Payout requests are processed within the timeframe specified on our website, subject to review and verification
  • We reserve the right to withhold, delay, or deny payouts if we detect any violation of our Terms, fraudulent activity, or manipulative trading behavior
  • Minimum payout thresholds and payout schedules are published on our website
  • Payouts are issued at our discretion and do not constitute wages, salary, or guaranteed compensation

Prohibited Activities

You agree not to engage in any of the following activities while using our Services:

  • Using exploits, bugs, latency arbitrage, or any form of system manipulation
  • Engaging in copy trading, account management, or allowing third parties to trade on your behalf
  • Operating multiple accounts or coordinating trades across accounts (hedging between accounts)
  • Using automated trading systems or expert advisors (EAs) unless explicitly permitted
  • Reverse-engineering, decompiling, or attempting to access the source code of our platform
  • Engaging in any form of market manipulation or abusive trading practices
  • Providing false or misleading information during registration or KYC verification
  • Using VPNs or proxies to circumvent geographic restrictions or identity verification
  • Attempting to exploit gap trading, high-frequency scalping during news events, or other strategies specifically prohibited in the challenge rules
  • Harassing, threatening, or abusing our staff or other users

Violation of any prohibited activity may result in immediate account termination, forfeiture of any pending payouts, and a permanent ban from our platform.

Intellectual Property

All content, trademarks, logos, designs, software, and materials on the Funded Ocean website and platform are our intellectual property or that of our licensors and are protected by applicable intellectual property laws.

  • You may not reproduce, distribute, modify, or create derivative works from any of our content without prior written consent
  • Your use of our Services does not grant you any ownership rights in our intellectual property
  • Any feedback, suggestions, or ideas you provide may be used by us without obligation or compensation to you

Limitation of Liability

To the maximum extent permitted by applicable law, Funded Ocean and its directors, officers, employees, affiliates, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Services
  • Loss of profits, data, goodwill, or other intangible losses
  • Any interruption, suspension, or termination of our Services, whether voluntary or involuntary
  • Unauthorized access to or alteration of your transmissions or data
  • Actions or inactions of third-party service providers, including payment processors and trading platforms

Our total aggregate liability for any claims arising from or related to these Terms or our Services shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

Disclaimers

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • Funded Ocean is not a broker, financial advisor, or investment firm. We do not provide financial, investment, or trading advice
  • Past performance on simulated accounts does not guarantee future results in live trading
  • We do not guarantee uninterrupted or error-free access to our platform or Services
  • Simulated trading results may not reflect actual market conditions, execution speeds, or liquidity

Termination

We may suspend or terminate your account and access to our Services at any time, with or without cause and with or without notice, including but not limited to:

  • Violation of these Terms or any challenge rules
  • Engaging in prohibited activities
  • Providing false or fraudulent information
  • Non-payment or chargeback disputes
  • Any other reason at our sole discretion

Upon termination, your right to use our Services ceases immediately. Any pending payouts may be forfeited at our discretion if termination results from a violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Funded Ocean operates, without regard to conflict of law principles. Any legal proceedings arising from or related to these Terms shall be brought exclusively in the courts of that jurisdiction.

Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or our Services, you agree to first attempt to resolve the matter informally by contacting us at support@fundedocean.com. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue formal dispute resolution.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on our website. We may, but are not obligated to, notify you of material changes via email or through our platform. It is your responsibility to review these Terms periodically.

Your continued use of our Services after any modifications constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our Services.

Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Funded Ocean regarding your use of our Services and supersede all prior agreements, understandings, and communications, whether written or oral.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
